What Is Assault Occasioning Actual Bodily Harm?

Assault occasioning actual bodily harm (ABH) is an offence under section 59 of the Crimes Act 1900 (NSW). It carries a maximum penalty of 5 years’ imprisonment (or 7 years if committed in company). ABH involves the application of force that causes injury beyond the transient or trifling — such as bruises, scratches, swelling, cuts, or minor fractures. The prosecution does not need to prove you intended the specific injury, only that the assault was intentional or reckless.
