What Is Affray?

Affray is an offence under section 93C of the Crimes Act 1900 (NSW), carrying a maximum penalty of 10 years’ imprisonment. It involves using or threatening violence in circumstances where a hypothetical bystander — a “person of reasonable firmness” — would fear for their personal safety. Unlike other assault offences, affray can involve multiple participants and can occur in both public and private settings.
