What Is Deemed Drug Supply?
Under section 29 of the Drug Misuse and Trafficking Act 1985 (NSW), possession of a trafficable quantity or more of a prohibited drug is “deemed” to be for the purpose of supply. The onus shifts to the accused to prove the drug was for personal use or another purpose other than supply. The penalties are the same as actual supply — up to life imprisonment for large commercial quantities.
