What Is Driving Whilst Disqualified?
Driving whilst disqualified is one of the most serious traffic offences in NSW. It is a criminal offence under section 54 of the Road Transport Act 2013 (NSW) and is treated more severely than driving whilst suspended because a disqualification is a court-ordered sanction. Penalties include fines of up to $5,500, imprisonment for up to 12 months for a first offence (up to 2 years for subsequent offences), and further licence disqualification of up to 3 years. Courts treat this offence extremely seriously as it involves defying a court order.
