What Is Driving Whilst Suspended?

Driving whilst your licence is suspended is a criminal offence under section 54 of the Road Transport Act 2013 (NSW). A licence suspension is an administrative action, typically imposed by Transport for NSW, police, or Revenue NSW for reasons such as excess demerit points, high-range speeding, drink or drug driving detections, or unpaid fines. Although having a suspended licence is not itself a criminal matter, operating a vehicle during a suspension period is a criminal offence that can result in fines of up to $3,300 for a first offence, up to 6 months’ imprisonment, and further licence suspension.
