Firearms and weapons offences are governed by the Firearms Act 1996 (NSW) and the Weapons Prohibition Act 1998 (NSW). Unauthorised possession of a prohibited firearm or pistol under section 7 carries a maximum penalty of 14 years’ imprisonment with a standard non-parole period of 5 years. Even possession of an unregistered non-prohibited firearm carries up to 5 years. Courts treat these charges extremely seriously due to public safety concerns.
