Ongoing supply of a prohibited drug is a serious indictable offence under section 25A of the Drug Misuse and Trafficking Act 1985 (NSW), carrying a maximum penalty of 20 years’ imprisonment and/or a fine of up to $385,000. Elements of Ongoing Supply
- You supplied, or knowingly took part in the supply of, a prohibited drug
- You did so on 3 or more separate occasions during a period of 30 consecutive days
- The supplies were of the same prohibited drug or of drugs containing the same prohibited drug
Penalties for Ongoing Supply
The maximum penalty is 20 years’ imprisonment and/or a fine of $385,000. This is a strictly indictable offence that must be heard in the District Court or Supreme Court. A sentence of full-time imprisonment is a realistic outcome.
Defences to Ongoing Supply
- Fewer Than 3 Occasions: The prosecution cannot prove three separate acts of supply within 30 days
- No Knowledge: You did not know the substance was a prohibited drug
- Different Drugs: The substances supplied on different occasions were not the same prohibited drug
- Duress: You were coerced or threatened into the supply
- Identification: You were not the person involved in the supply
