What Is Wounding?

Wounding is a serious offence under sections 33 and 35 of the Crimes Act 1900 (NSW). At common law, wounding requires the breaking or cutting of the skin. Wounding with intent carries a maximum of 25 years’ imprisonment and is strictly indictable. Reckless wounding carries up to 7 years (or 10 years in company). Defences include self-defence, consent, duress, and challenging whether the injury meets the legal definition of a wound.
