What Is Drug Driving?
It is an offence under section 111 of the Road Transport Act 2013 (NSW) to drive a motor vehicle while a prescribed illicit drug is present in your oral fluid, blood, or urine. This is a “presence” offence — the prosecution does not need to prove your driving was actually impaired. The four substances tested for are THC (cannabis), methylamphetamine (ice), MDMA (ecstasy), and cocaine. For a first offence with no prior major traffic offence in 5 years, you may receive an infringement notice (approximately $572 fine and 3-month licence suspension). If the matter goes to court, the maximum fine is $2,200 with an automatic 6-month licence disqualification.
